Terms of Service

By accessing or using the QuickDeliver platform ("Platform"), including our website, mobile application, and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email or in-app notification.

"Platform" refers to the QuickDeliver application, website, and all associated services. "User" or "Customer" refers to any individual who accesses or uses the Platform to place orders. "Store Partner" refers to restaurants, shops, and other businesses that list their products on the Platform. "Delivery Partner" refers to independent contractors who deliver orders placed through the Platform.

"Order" refers to a request placed by a User for products from a Store Partner. "Services" refers to the technology platform connecting Users, Store Partners, and Delivery Partners.

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You must provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

The Platform enables you to browse menus, place orders, and arrange delivery from Store Partners. QuickDeliver acts as an intermediary platform connecting Users with Store Partners and Delivery Partners.

All orders are subject to acceptance by the Store Partner. We do not guarantee the availability of any product listed on the Platform. Store Partners may cancel or modify orders due to product unavailability, pricing errors, or other reasons.

Order confirmation does not constitute a binding contract for delivery until the Store Partner accepts the order. Estimated delivery times are approximate and may vary based on demand, weather, traffic, and other factors.

Delivery services are provided by independent Delivery Partners. While we strive to ensure timely delivery, we do not guarantee specific delivery times. Delivery estimates are provided for reference only and may vary.

You must provide accurate delivery address and contact information. If a delivery cannot be completed due to incorrect information provided by you (wrong address, unreachable phone number, etc.), additional charges may apply for re-delivery.

You or your authorized representative must be available to receive the order at the specified delivery address. If no one is available, the Delivery Partner may attempt to contact you. Undeliverable orders may be returned to the Store Partner.

Prices displayed on the Platform are set by Store Partners and may differ from in-store prices. All prices are in Indian Rupees (INR) unless otherwise stated. Prices include applicable taxes unless separately itemized.

You agree to pay the total amount for your order, including product prices, delivery fees, taxes, and any applicable service charges. Payment methods accepted include cash on delivery (COD), UPI, credit/debit cards, and digital wallets as available.

We use secure third-party payment processors and do not store your complete payment information. By providing payment information, you represent that you are authorized to use the selected payment method.

You may cancel an order before the Store Partner begins preparing it, subject to our Refund Policy. Once preparation has begun, cancellation may not be possible or may be subject to charges.

QuickDeliver or the Store Partner may cancel an order due to product unavailability, store closure, inability to deliver, suspected fraud, or other operational reasons. In such cases, any payment made will be refunded as per our Refund Policy.

You agree not to: (a) use the Platform for any unlawful purpose; (b) impersonate any person or entity; (c) interfere with or disrupt the Platform or its infrastructure; (d) attempt to gain unauthorized access to any part of the Platform; (e) use automated tools to access or scrape the Platform without prior written consent.

You agree to treat Store Partners, Delivery Partners, and QuickDeliver staff with respect. Abusive behavior, harassment, or threats may result in suspension or termination of your account.

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and trademarks, is the property of QuickDeliver or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

QuickDeliver acts as an intermediary platform and is not responsible for the quality, safety, or legality of products offered by Store Partners. We do not manufacture, store, or handle food or other products listed on the Platform.

To the maximum extent permitted by law, QuickDeliver shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from your use of the Platform shall not exceed the amount paid by you for the specific order giving rise to the claim.

You agree to indemnify, defend, and hold harmless QuickDeliver, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any pending orders may be cancelled.

You may deactivate your account at any time by contacting our support team. Termination does not relieve you of any obligations incurred prior to termination, including payment for completed orders.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Before initiating any legal proceedings, you agree to attempt to resolve any dispute informally by contacting our support team. If the dispute is not resolved within 30 days, either party may pursue formal resolution.
